First published on 10 October 2024, the Employment Rights Bill went through a turbulent 14-month Parliamentary journey before receiving Royal Assent just before Christmas 2025. Along the way, significant amendments, delays, and last-minute changes have left many employers unclear about what actually made it into the final Act and when their legal obligations begin. That uncertainty carries real risk. The Employment Rights Act 2025 introduces new statutory duties for employers, with staggered commencement dates that will catch out organisations that are not prepared. Getting this wrong could expose your organisation to employee claims, enforcement action, reputational damage, and costly tribunal awards. Kathy Daniels FCIPD, FCMI, PFHEA specialises in employment law, writing for a range of sources and also speaking and training across the UK. She is also a Professor at Aston University where she is Associate Pro-Vice Chancellor (Engagement). She is a lay member of the Employment Tribunals, sitting in Birmingham and a fellow of the Chartered Institute of Personnel and Development (CIPD).
